Use of Digital Adventures Site

  1. Access. In order to access certain Services, you may be required to provide personal information as part of the registration process. You shall provide Digital Adventures with correct registration information and update it as necessary to maintain its correctness for as long as you continue to use any of the Services on this site by contacting Digital Adventures. You agree to use the Services only for purposes that are permitted by the Agreement and any applicable law, regulation, generally accepted practices, or guidelines in the State of Illinois and the United States. You agree not to access (or attempt to access) any of the Services by any means other than through the interface provided by Digital Adventures.
  2. Site Operation. You will not engage in any activity that interferes with or disrupts the operation of the site. You agree to not reproduce, duplicate, copy, sell, trade, or resell the Services for any purpose. You are solely responsible for, and Digital Adventures has no responsibility to you or to any third party for, any breach of your obligations under the Agreement and for the consequences of any such breach including any loss or damage which Digital Adventures or you may suffer.
  3. Account Confidentiality. You are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Services. Accordingly, you will be solely responsible to Digital Adventures for all activities that occur under your account. Medical Information

If any minor child listed in the Registration Form (“Participant”), needs injections (e.g. insulin, etc.) Participant will be required to self-administer or have his or her Parent/Legal Guardian administer his or her medication. Parents/Legal Guardians agree that it is the responsibility of the Parent/Legal Guardian to retrieve Participant’s medication from Digital Adventures staff at the end of the program, activity, or event. All medication(s) that are left behind will be disposed of at the end of the program, activity, or event. Should Digital Adventures obtain possession of any medication pursuant to this policy, Digital Adventures shall not be responsible for any damages or liabilities related in any way to such medication, its disposal, or Digital Adventures’ failure to dispose of such medication, including, but not limited to the replacement cost of the medication and any damages resulting from Participant’s failure to administer such medication. Digital Adventures, by law, is not allowed or permitted to mail medication. Please retrieve all medication before leaving the program location.

Lost, Stolen or Damaged Property

Participants are responsible for their personal property while attending any program, activity, or event offered by Digital Adventures. Digital Adventures is not responsible for any personal belongings lost or damaged by casualty, theft, or otherwise. Parents/Legal Guardians agree to accept full responsibility, financially or otherwise, for the conduct of Participant, including but not limited to damage to equipment or facilities. Digital Adventures is not required or expected to protect Participants from theft or damage to property.

Cancellations, Refunds and Missed Attendances

All refund requests and special considerations must be submitted in writing to [email protected]

Cancellations submitted in writing 7 days before the start date of the program, activity, or event are eligible for a full refund, with the exception of the nonrefundable deposit.

Customers may choose to leave their refund as a credit on their account for 12 months. New registration must be completed within one year of cancellation date; in this case, credits will be retained in full, without incurring any cancellation fees.

Beginning on the start date, no refunds will be issued for early withdrawal or dismissal due to absences for any reason, including sickness or behavioral dismissals except at the sole discretion of Digital Adventures.

If a Participant cannot attend a Digital Adventures program, activity, or event that has been previously paid for by the Participant due to an unexpected illness, Digital Adventures has the sole discretion to offer refunds or accommodate the participant in an alternate program and has the right to request a signed doctors note for proof of illness or a written explanation of such illness. In the case of family emergency, Digital Adventures may provide refunds and attempt to accommodate Participants in an alternate program at Digital Adventures’ sole discretion.

State Licensing Requirements

Digital Adventures is a license-exempt child care center under the State of Illinois and is not regulated under the Illinois Department of Child and Family Services.

You may not use the site and may not accept any terms of the Agreement if (1) you are not of legal age to form a binding contract with Digital Adventures, or (2) you are a person barred from receiving the Services under the laws of the United States or other countries, including the country in which you are a citizen or from which you use the site.

In accordance with the Children’s Online Privacy Protection Act, an individual must be 13 years of age or older to complete and submit any forms or provide any personal information on this site.

Digital Adventures reserves the right to amend the Agreement at any time and without notice. Any amended Agreement and the date of its amendment will be posted on the Terms and Conditions page. Your continued use of the site and any Services after any such amendments constitutes your acceptance of the amended Agreement. If you do not agree to any of these terms or any future terms in this Agreement, you shall not continue to use or access the site or any Service offered by Digital Adventures. The Agreement applies to all visitors, users, and others who (1) access the site, (2) purchase, (3) download, or (4) receive materials from Digital Adventures.

Consent and Release

I, the legal parent/guardian of the minor child listed in the Registration Form (“Participant”), for ourselves, our heirs, executors, and administrators, hereby release, waive, acquit and forever discharge Digital Adventures, their representatives, successors, insurers, assigns, or any other person or entity associated with any of the above organizations (such as staff, directors or volunteers), from all liability, claims, demands, or causes of action for any and all loss, damage, injury, or death and any claim of damages resulting from use of facilities owned or controlled by the above organizations, or participation in activities of said organizations either at or away from Digital Adventures.

I authorize Digital Adventures, acting through its agents, employees, or representatives, to take photographs, video recordings, and/or audio recordings of the Participant, including their name, their image, their likeness, their performance, and/or their voice ("Recordings"). I also grant Digital Adventures an unlimited right to reproduce, use, exhibit, display, perform, broadcast, create derivative works from, and distribute the Recordings in any manner or media now existing or hereafter developed, in perpetuity, throughout the world. I agree that the Recordings may be used by Digital Adventures, including its assigns and transferees, for any purpose, including but not limited to marketing, advertising, publicity, or other promotional purposes. I agree that Digital Adventures will have final editorial authority over the use of the Recordings, and I waive any right to inspect or approve of any future use of the Recordings. I acknowledge that I am not expecting to receive compensation for participating in the Recordings or for any future use of the Recordings. I release and fully discharge Digital Adventures, and its agents, employees, and representatives from any claim, damages, or liability arising from or related to their participation in the Recordings or company's future use of the Recordings.
